Frequently asked questions
Does the CNPJ (company registration) protect the company name as a trademark?
No. The corporate name registered with the Board of Trade (Junta Comercial) and the trademark registered with the INPI (Brazilian PTO) are different protections. To use the name as a trademark exclusively nationwide, what counts is the INPI registration.
Can I use the trademark while the application is under review?
As a rule, yes, as long as the prior search does not point to a conflict with earlier trademarks. The application secures the priority date; monitoring is used to respond to oppositions and office actions until the INPI decides.
